TERMS AND CONDITIONS OF THE MYRAW.EU ONLINE STORE

§ 1. General Provisions

  1. The Online Store available at the internet address www.myraw.eu is operated by: POLIMER Prosta Spółka Akcyjna with its registered office in Marki, at ul. Piłsudskiego 123c, 05-270 Marki, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court in Warsaw, Commercial Division of the National Court Register under KRS number: 0001109711, VAT ID (NIP): 1251769394, REGON: 528836557, share capital: PLN 5000 (fully paid up).

  3. These Regulations are addressed to both consumers and entrepreneurs using the Store, unless a given provision states otherwise.

  4. Nature of products: The products available in the Store are complementary pet food intended exclusively for animals (dogs). These are not medicinal products (veterinary medicines) and cannot be treated as a substitute for treatment recommended by a veterinarian. In case of doubts regarding the animal's diet, the Client should consult a veterinarian.

§ 2. Definitions

  1. Client – any entity placing an Order in the Store.

  2. Consumer – a natural person performing a legal act with an entrepreneur not directly related to their business or professional activity.

  3. Entrepreneur with consumer rights – a natural person concluding a contract directly related to their business activity, when the content of this contract shows that it does not have a professional character for them.

  4. Product – a movable item available in the Store (in particular dietary supplements for dogs) being the subject of the Sales Agreement between the Client and the Seller.

  5. Terms and Conditions – these regulations of the Store.

  6. Store – the online service run by the Seller at the address myraw.eu on the Shopify platform.

§ 3. Technical Requirements and Rules for Using the Store

  1. To use the Store, including browsing the assortment and placing orders, the following are necessary:

    • an end device with Internet access and a web browser (e.g., Google Chrome, Mozilla Firefox, Safari) supporting cookies and JavaScript;

    • an active electronic mail account (e-mail);

    • a program capable of opening PDF files (e.g., Adobe Acrobat Reader) – in order to read documents sent by the Seller.

  2. The Seller, to the widest extent permitted by law, shall not be liable for disruptions, including interruptions in the functioning of the Store caused by force majeure, unauthorized action of third parties, or incompatibility of the Online Store with the Client's technical infrastructure.

§ 4. Order Placement Procedure

  1. Browsing the Store's assortment does not require creating an Account.

  2. The Client places orders in two ways:

    • as a Guest (without registration);

    • as a Registered User (after logging into the Account).

  3. In order to place an Order, one must:

    • Select the Product and its quantity, then click the "Add to cart" button.

    • Go to the "Cart" view and follow the instructions.

    • Fill in the Order Form, providing data necessary for shipping and choose the delivery and payment method.

    • Accept the Terms and Conditions and (optionally) consent to other statements.

    • Click the "Buy and pay" button (or equivalent).

  4. Placing an Order constitutes a declaration of intent by the Client to conclude a Sales Agreement with the Seller.

  5. After placing the Order, the Client receives an e-mail confirming the receipt of the Order by the Store, which is equivalent to the conclusion of the Sales Agreement.

§ 5. Payment Methods

  1. Product prices listed in the Store are gross prices (include VAT) and are expressed in Polish Zlotys (PLN).

  2. The Store provides the Client with the following payment methods handled by the operator Tpay:

    • BLIK payment;

    • Fast online transfers (Pay-by-link);

    • Payment card (Visa, Mastercard).

  3. The Client is obliged to make the payment within [e.g., 1 hour / 24 hours] from the moment of concluding the Sales Agreement. In the absence of payment within this period, the Seller has the right to cancel the order.

§ 6. Delivery

  1. Delivery of Products takes place within the territory of the Republic of Poland.

  2. Delivery is carried out via the operator InPost:

    • InPost Parcel Lockers 24/7 (Paczkomaty);

    • InPost Courier.

  3. Delivery costs are indicated to the Client at the time of placing the Order (in the "Cart").

  4. The order processing time (completion and shipment) is usually from 1 to 3 business days from the moment the payment is credited. To this time, the carrier's transport time must be added.

§ 7. Right of Withdrawal

  1. The Consumer and the Entrepreneur with consumer rights have the right to withdraw from the Sales Agreement within 14 days without giving any reason.

  2. The period for withdrawal from the agreement begins on the day on which the Client (or a third party other than the carrier indicated by them) took possession of the Product.

  3. To exercise the right of withdrawal, the Seller must be informed of the decision by way of an unequivocal statement (e.g., a letter sent by post to the company's address or by e-mail to the Store's e-mail address).

  4. Exceptions to the right of withdrawal: According to Art. 38 of the Consumer Rights Act, the right of withdrawal generally does not apply to contracts where the subject of the service is an item delivered in a sealed package, which after opening the package cannot be returned due to health protection or hygiene reasons, if the packaging was opened after delivery (this applies to most dietary supplements after breaking the security seal).

  5. In the event of effective withdrawal from the agreement, the Seller returns to the Client all payments received, including the costs of delivery of the item (except for additional costs resulting from the method of delivery chosen by the Client other than the cheapest standard method of delivery offered by the Seller), immediately, and in any case no later than 14 days from the day on which the Seller was informed about the decision.

  6. Returns of goods must be made to the address: POLIMER P.S.A., ul. Piłsudskiego 123c, 05-270 Marki, Poland.

§ 8. Complaints and Conformity of Goods with the Contract (Warranty)

  1. The Seller acts under the obligation to deliver the Product to the Client in conformity with the concluded contract.

  2. The basis and scope of the Seller's liability towards the Consumer in the event of non-conformity of the goods with the contract are defined by generally applicable laws, in particular the Consumer Rights Act.

  3. In the event of finding non-conformity of the goods with the contract, the Consumer has the right to file a complaint. A complaint can be submitted:

    • In writing to the address: ul. Piłsudskiego 123c, 05-270 Marki;

    • Electronically to the e-mail address: kontakt@myraw.eu.

  4. In the complaint notification, it is recommended to provide:

    • information and circumstances regarding the subject of the complaint (type and date of occurrence of the defect);

    • a request for the method of bringing the Product into conformity with the contract (replacement) or a declaration of price reduction or withdrawal from the contract;

    • contact details of the person filing the complaint.

  5. The Seller will respond to the Consumer's complaint immediately, no later than within 14 days from the date of its receipt. Failure to respond within this period means that the Seller considered the complaint justified.

§ 9. Out-of-court Complaint Consideration and Redress Methods

  1. Detailed information regarding the possibility for the Consumer to use out-of-court complaint consideration and redress methods and the rules of access to these procedures are available at the offices and on the websites of district (city) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Trade Inspection, and at the website of the Office of Competition and Consumer Protection (UOKiK).

  2. The Consumer has the following possibilities, among others:

    • applying to a permanent arbitration consumer court;

    • applying to the provincial inspector of the Trade Inspection;

    • using the ODR (Online Dispute Resolution) platform available at: http://ec.europa.eu/consumers/odr.

§ 10. Personal Data Protection

  1. The Controller of Clients' personal data collected via the Online Store is the Seller.

  2. Clients' personal data are collected for the purpose of implementing the Sales Agreement, and if the Client consents – also for marketing purposes.

  3. Recipients of Clients' personal data may be, in particular, carriers (InPost) and the entity handling electronic payments (Tpay).

  4. Detailed information regarding data processing can be found in the Privacy Policy available in the Store.

§ 11. Final Provisions

  1. Contracts concluded via the Online Store are concluded in the Polish language.

  2. The Seller reserves the right to make changes to the Terms and Conditions for important reasons (e.g., changes in legal regulations, changes in payment and delivery methods). The Seller will inform Clients about each change at least 7 days in advance by publishing the new Terms and Conditions on the Store's website. The existing provisions apply to orders placed before the entry into force of the changes.

  3. In matters not covered by these Terms and Conditions, generally applicable provisions of Polish law shall apply, in particular: the Civil Code and the Consumer Rights Act.
